TWO men had sex with a drunk and frightened 13-year-old girl after she and a friend were plied with alcohol at a house in Burnley, a court was told.

The teenager said Shafique Miah, 22, had sex with her upstairs before the other man went into the bedroom and did the same thing to her.

The girl, who ended up with a ‘love bite’ on her neck from the defendant, could hear her friend sobbing during the incidents in March last year, Burnley Crown Court heard.

The hearing was told how Miah was later arrested and made no comment to police. Both girls picked him out on a video identity parade.

Miah, of Brougham Street, Burnley, denies sexual activity with a child, inciting a child to engage in sexual activity and two allegations of arranging or facilitating the commission of a child sex offence.

Joanne Rodikis, prosecuting, told the jury the two girls left the house at about 11.30pm and when the 13-year-old’s friend got back to her home she was very distressed.

The friend had been reported missing.

She was angry, lashing out and said she had been sexually assaulted.

Police were called, that led them to the 13-year-old’s door and both girls made formal complaints to officers.

Miss Rodikis said Miah was arrested and questioned, made no comment but was picked out on the ID parade.

The teenager was examined by a doctor and was found to have minor injuries consistent with recent sexual intercourse.

She also had bruises to her neck, consistent with a love bite.

Swabs were taken from the schoolgirl and DNA which matched the defendant’s profile was recovered from them.

Asked by an officer, “Are you bothered about what happened?” the girl replied: “A bit.”

She said she had not told the men she did not want sex with them, but added: “I was drunk and I was scared.”

The officer asked the teenager: “Do you think it’s right doing what they did knowing that you were drunk?”

The 13-year-old answered: “No.”
