Two-week booze ban for Barnoldswick store


A STORE has been given a two-week booze ban after being criticised by councillors for selling alcohol to underage customers.

Police had hauled bosses at the Happy Shopper, in Coates Avenue, Barnoldswick, before Pendle Council’s licensing committee after the premises failed three test purchasing operations in 14 months.

But licence holder Sikander Nawaz, of Clifton Road, Reedley, claimed he had been let down by staff, two of whom had been sacked as a result of the failures.

Richard Williams, representing Lancashire Police, told the committee that the shop had failed ‘sting’ operations in August and November 2008, and October 2009.

The last ‘sting’ saw a 16-year-old boy go into the Happy Shopper and select four cans of export-strength lager, a packet of crisps and a bottle of Vimto.

Councillors heard that the shop assistant was on the phone at the time but asked the young man for a form of identification.

The boy handed over a passport, with a date of birth in 1993, but the assistant just glanced at it before completing the sale.

Mr Williams said the police were not asking for the store’s licence to be permanently revoked but the incident with the passport showed their approach to under-age sales was “sloppy”.

Gill Sherratt, representing Mr Nawaz said her client had run the Happy Shopper for five-and-a-half years and, up until 2008, had been regarded as a responsible trader.

Following the first test purchasing failure a staff member, who had completed certificated licensing training, had been dismissed.

The same thing happened after a second staff member, trained internally, was caught out.

Mr Nawaz told councillors that on the third occasion he had been in Pakistan and had been calling the store to check up on his business when the sale occurred.

He said: “No one can now use the telephone while a customer is in the shop, even if I am ringing them, they must end the call until the person is served.”

The committee, chaired by Coun Linda Crossley, imposed the fortnight alcohol sales restriction, alongside a series of conditions designed to ensure staff are properly trained to avoid future underage sales.

Remove his licence for good as he is obviousley not in control of his shop.
Weather he is at home or abroad he still is the licencee. Until a hard line is taken against these people they will continue to break the law. Two week ban bo**ocks.

What is there about the law that says you cannot sell alchohol to underage people that these off licence owners do not understand? Oh! and isn't it strange that it is always someone else who does it, never the owner.

This ban will certainly make all the other off licences wake up and take notice that the Police and local council are now taking a tough stance. This is a second offence so I think his licence should be taken away permantly. Doesn't matter next time they are caught no doubt he'll again be in Pakistan and tell everyone that he's sacked the person responsible and get another 2 week ban. Pathetic

When you consider the amount of time and energy that has allegedly gone into this prosecution, it is a joke. Underage drinking costs the local community a great deal more than a few quid. Damage to property, attacks on the elderly, unsocial behaviour of all types: just take away his booze licence. It is not rocket science. Everyone knows that having " a licence" means that it is a licence to print money!! Usually, these people regulate themselves, and it is only sting operations like this that will worm out the scumbags who are at the heart of anti-social , criminal behaviour, that we are all witness to, just by walking down the street at certain times of day. The ' Licencee', if I can coin sutch loose a term, is making thousands of pounds, every day ( well, people aren't going into pubs, are they ?) I advise take away this Loser's ability to sell booze FOREVER , that will make him think whether he wants to live in the UK, or somewhere else. A two week ban is a total joke, and I would not be surprised if this makes the front page of the ' red tops'. Evidently, the Licencee, Mr Sikander Niwaz lives in Reedley---- would that be the Reedley in the environs ofthe Magistrates Court?. How come it took THREE visits, in this sting opertation, over 16 months, to bring a prosecution ? Take away his booze licence, NOW, and investigate him for other, possible, misdemeanors.
