A DRUNKEN man who went into a McDonald's restaurant late at night helped himself to £90 from the till when he realised there was no one behind the counter.
Blackburn magistrates heard Sean Robert O'Callaghan left without dining but was identified later from CCTV footage.
O'Callaghan, 27, of York Street, Nelson, pleaded guilty to burglary at McDonald's on North Valley Road, Colne, and theft of £90.
He was made subject to a community order for 12 months with 15 days rehabilitation activity requirement, fined £50 with £90 compensation, £85 costs and £85 victim surcharge.
Tracy Yates, prosecuting, said O'Callaghan had committed the offence at 2.50am.
He told police that when he noticed there was nobody behind the counter he leaned over and pressed a few buttons and the till opened.
Nick Cassidy, defending, said his client had been drunk but other than that was at a loss to explain his actions.
"There was no confrontation or antagonism towards the staff," said Mr Cassidy.
"He was approached by the police a couple of days later and immediately admitted committing the offence."
