A MAN brandished a knife in a street before fighting with another man over a row about an alleged burglary, a court heard.

Fraser Robertson and Graham Hughes were captured on CCTV fighting after arguing on Ferrier Close, Blackburn, in August last year.

Robertson, 24, and Hughes, 35, were both spared immediate prison sentences after they appeared before Preston Crown Court.

CCTV footage played in court showed Hughes waiting in Ferrier Close with Robertson walking towards him.

The pair start talking to each other and the footage showed Hughes produce a knife in his left hand, before the pair start pushing and shoving.

Mark Kellett, prosecuting, said nearby residents had said they saw the two men fighting.

He said Hughes had come off worse from the fight.

He said: “He had several bruises and had a fractured cheekbone. The two were arrested and interviewed.

“He admitted he was a bit drunk.

“He was described as being agitated because he had been stabbed previously.”

Robertson had pleaded guilty to affray and Hughes had pleaded guilty to affray and having possession of a kitchen knife.

Neil Howards, defending Hughes, said his client was diagnosed with post-traumatic stress disorder after being stabbed in 2016.

He said: “At the time he was still coming to terms with being stabbed.

“He was drinking a great deal."

“He dropped out of uni and was in debt.

“He was in a dark place on that night.”

Isobel Thomas, defending Robertson, said her client was accused of burglary by Hughes, which he denies.

She said: “He does regret acting in the way he did.

“He does accept that he was having some difficulty understanding the consequences of his actions."

“His focus is to be a good father to his child.

“Probation said there are things they can do.”

Hughes, of Hillside Avenue, Blackburn, was given a 12-month prison sentence, suspended for two years, ordered to complete 40 rehabilitation activity requirement days and ordered to work 100 unpaid hours.

Robertson, of Fecitt Brow, Blackburn, was given a 12-month prison sentence, suspended for two years, ordered to complete 25 rehabilitation activity requirement days and 100 hours of unpaid work.

They were given a two-year restraining order to not make contact with each other.

Roberston was ordered to pay £250 as a contribution towards costs and Hughes was ordered to pay £150 towards costs.

Judge Jonathan Gibson said: “Mr Hughes had a knife and brandished it, in the circumstances it was potentially dangerous.

“Mr Robertson reacted and struck Mr Hughes and caused him relative serious injuries.”
