A 48 year old man who went to his ex-partner's home to collect his coat has been jailed for 20 weeks.

Blackburn magistrates heard the visit put Paul Alan Hartley in breach of a restraining order and a suspended prison sentence imposed for an assault on Angela Schillaci.

But the court was told the night before she had turned up at his house in a drunken state and assaulted him. And she only agreed to leave if he walked her home.

Hartley, of Wynotham Street, Burnley, pleaded guilty to breaching the restraining order which was made on April 13. He was jailed for 20 weeks.

Catherine Allan, prosecuting, said Miss Schillaci was sitting in her living room watching TV at about 6.45 pm when she heard Hartley shouting her name from the back alley. She saw his arm come over the gate to open in and she shouted at him to go away.

Mark Williams, defending, said Miss Schallani had heard her name shouted twice and seen the defendant's arm come over the gate.

"She shouted at him to go away and he did," said Mr Williams. "He had given her his jacket when he walked her home the night before and he called to see that she was alright and to get his coat back. That is the full extent of the offence and I would ask you to consider whether it would be unjust to activate the suspended sentence."
