Taxi driver beaten unconscious

A TAXI driver was beaten unconscious and left covered with blood after ordering an unruly passenger out of his cab, a court has heard.

Mohammed Hayat told David Bailey, 21, to get out of his cab after he had pulled on the handbrake of the vehicle and was disruptive.

Bailey then attacked Mr Hayat, elbowing him and punching him in the face before his friends, who were also in the cab, joined in.

Mr Hayat suffered a 4cm long cut to his forehead and swollen nose in the attack and was unable to visit his sick month in Pakistan, Burnley magistrates heard.

Bailey, of Coalclough Lane, Burnley, admitted assault causing actual bodily harm.

He was given a 12 month community order. The bench, who told him the offence was "very, very serious", ordered him to pay £100 compensation and £50 costs.

Bill Maude, prosecuting, told the court Mr Hayat, who was based in Burnley, picked up five customers on Reed Street at about 11.10pm.

The defendant sat in the front passenger seat and was clearly the worse for drink, persistently knocking the taxi out of gear and interfering with the victim's radio.

Bailey then pulled on the handbrake of the vehicle, tore a sticker off the dashboard and threw some cards into the back of the cab.

Mr Maude said Mr Hayat stopped, told the group he did not want to take them any further because of the defendant's behaviour and told them to get out.

As Bailey left the taxi, he elbowed the driver and Mr Hayat walked around the front of the vehicle to try and close the door.

Bailey was standing in the way and punched Mr Hayat around the left eye, causing him to fall backwards. Mr Hayat was in pain but managed to get back to his feet and tried to defend himself. Two of the other passengers then joined in and the victim was again floored and thought he was briefly knocked unconscious.

Mr Maude said Mr Hayat alerted the police and another driver took him to hospital.

Bailey was arrested and charged and when questioned agreed he had been present but claimed he had been defending himself. He had 14 previous convictions.

Nick Cassidy, defending, said Bailey had been in high spirits in the taxi and there may have been some element of bravado. He had been to the pub with friends and accepted he had been drinking.

The defendant, who had not had a full recollection of events, apologised for his conduct.

Maybe they should start sending ppl down. An innocent guy doing his job and you get yobs like this. drink is not an excuse.

Unfortunately the circumstances of the offence do not pass the 'custody threshold'...in consequence the magistrates were not able to send him down!

This man is a habitual offender. 14 previous convictions is absolutely shameful.

He committed a violent assault and should be punished accordingly.

The fact that the circumstances of his offence do not pass the "custody threshold" is an utter disgrace.

This custody threshold should not exist and each case should be judged individually. Granted if it was a first time offender a community sentence and the shame may be enough but this man is blatantly not bothered in the slightest by a conviction.

What kind of message is this sending to others with no respect whatsoever who act violently to innocent members of the public?!?

The justice system is a total joke and this Government are perpetuating and promoting a care free society with no deterrent to crime.

The only reason the custody threshold is so high is because the Government has neglected to build new jails in-line with their liberal attitude towards crime and the lack of respect in society.

Get these idiots out and someone in that is going to deal with anti-social and criminal behaviour with the severity that it warrants.

It's blokes like 'bnpfollwer' that makes Burnley such a wonderful place to live...I'll bet you beat up charity workers in fancy dress in your spare time...''Well,you have to keep those bloody dragons off the streets,eh? otherwise they'll steal all our jobs and sleep with all our human women...''

Well Im totally stunned by the feeble weak gutless inapropriate sentence given to this complete animal who carried out this vcious unprovoked attack, not only could he have killed the driver but also injured other road users by his actions.
WHAT DETERENT !!
I dispair no wonder people have no faith in the justice system.
I wish the government would hear our plea.
GET TOUGH ON THE GUILTY they ARE the causes of crime!!

We NEED the powers that be, to protect us community service my backside, no doubt he will get off with doing that because he has to wear a protective hat !!

The indigenous population as well as ethnic minorities all have a certain element within them that are anti-social scum with no respect for their neighbours or the law.

These people, whatever colour they are, are the scourge of our society.

If immigrants are hard working, honest, law abiding people with respect for others who cares where they come from!

I would rather have ten immigrants like this than for every one person like David Bailey or BnpFollower!

Yet another story which highlights how pathetic our so called criminal justice system is,it won't be long before they lock up all the innocent harworking folk to protect them from the scum that seem to rule these days.
Bring back capital punishment that would free up space in our overcrowded prisons, the government needs to act now bfore the decent folk take the law into their own hands and start forming "vigilante states".
C'mon Mr Brown now's your chance to turn this country around and make history as a PM who did make a difference!
