A 42-YEAR-OLD woman banned from her mother’s home by a restraining order was found at the Darwen address with her mum in tears and clearly distressed.

But Blackburn magistrates heard Anne-Marie West had been living at the address for five weeks – with her mother’s permission.

West, of Bridge Street, Darwen, pleaded guilty to breaching a restraining order.

She was made subject to a curfew between 9pm and 7am for eight weeks and ordered to pay £85 victim surcharge.

Catherine Allan, prosecuting, said the restraining order had been made against West because of an assault on her mother. Police were called to a report of an incident and found Margaret West in the front room of her home on Birch Hall Avenue.

“She was shaking and extremely upset,” said Miss Allan.”

She asked police to remove her daughter but also confirmed she had been living there for five weeks with her permission.”

Jonathan Taylor, defending, said West had separated from her partner and was having difficulty finding accommodation.

“She asked her probation officer if it would be appropriate for her to live with her mother until she could move into her new flat,” said Mr Taylor.

“It seems the probation officer hadn’t fully understood the circumstances or been aware of the restraining order. My client accepts the order was made against her and it was her responsibility to understand it.”
