A MAN has been locked up for raping a 12-year-old girl twice at a house party in Blackburn.

Shay Barnes, 18, was sent to a young offenders detention centre for seven years for the attacks on the youngster, who cannot be named for legal reasons.

Blackburn Magistrates’ heard how at the same party in March, the victim’s 12-year-old friend was urinated on by a 17-year-old boy after she had passed out drunk.

Catherine Allan, prosecuting, said the two girls had gone to a house party where they had drunk to excess.

The first girl went upstairs with Barnes and she was raped.

Barnes, of Crediton Close, Blackburn, was locked up by a judge at Preston Crown Court after being convicted on two counts of child rape.

He was made subject of a sexual harm prevention order, which will remain in force until a further order is made by the court to lift it.

A recommendation was also made for him to be placed on the disclosure and barring list, which means he will have to declare his conviction when applying for any job that involves working with vulnerable people, including children.

Speaking after the hearing, Det Sgt Mark Whelan, from the Engage team at Lancashire Police, said: “We’re very pleased with the seven year sentence for Shay Barnes. His behaviour was completely unacceptable and will not be tolerated. Now he is rightly behind bars.

“Plying children with alcohol to such an extent that one of them passed out and was then urinated on is a disgusting crime. And I hope that defendant’s sentence is sufficient enough to prevent him from doing anything similar again.”

The 17-year-old, who cannot be named for legal reasons, was initially arrested on suspicion of a serious sexual offence involving the girl he urinated on. But after the case went to crown court the prosecution replaced it with an assault charge and the judge referred it back to the magistrates court.

Miss Allan said the girl had made a victim impact statement which revealed that since the incident on March 8 she had suffered severe depression and had tried to take her own life.

“She says the offence had changed her life and how she thought of herself,” said Miss Allan.

Debbie Morgan, defending, said her client, who had never been in any kind of trouble before, was ‘extremely ashamed’ of what he had done.

“He went to the wrong party with the wrong people,” said Miss Morgan.

Miss Morgan said he was now aware of what had gone on with the other girl and was very shocked by that.

The teenager pleaded guilty to assault. He was made subject to a referral order for 12 months and ordered to pay £200 compensation, and £100 costs. He was also made subject to a restraining order for 12 months.

Passing sentence the chairman of the magistrates said they had heard details of a horrific incident.

“To urinate on someone is humiliating and degrading and as we have heard it had a serious affect on this young girl,” she added.
