Developer loses appeal over Padiham takeaway bid

A DEVELOPER has lost a planning appeal to convert a Padiham property into a takeaway.

Agents for Risebrook Properties had claimed that they should be allowed to serve hot food at the Church Street shop.

And after seeing their proposals rejected by Burnley Council’s development control committee last June, an appeal was lodged with the Planning Inspectorate.

But after reviewing the case, and admitting the issue was ‘finely balanced’, planning inspector Robin Brooks has agreed with the councillors’ decision.

Mr Brooks felt that, despite how effective a flue may be at the back of the proposed takeaway, residents in nearby Dragon Street and Back Shuttleworth Street would still suffer unacceptable levels of food odours.

The inspector said he did appreciate the argument that it was better for the property to be occupied by a takeaway than remain vacant but ruled in favour of the residents’ amenity rights.
